Regulation (EU) 2023/1542
Batteries Regulation
Batteries and Waste Batteries Regulation
EV, industrial and portable batteries sold in the EU need carbon footprints, recycled content, due diligence on raw materials, and a passport — plus collection and recycling that actually happens.
Does this hit me?
A laptop or e-bike battery should be easier to replace over time. EV buyers get footprint information. You do not register a passport.

How it rolls in
Aug 2023
Entered into force.
Feb 2024+
Staggered application of chapters.
Feb 2027
Due diligence and several carbon-footprint duties.
2028
Recycled-content and passport milestones for specified categories.
Why it exists
The car and grid transition is a metals transition. The Union wanted the value chain on its territory to be cleaner, more circular, and less naïve about cobalt and lithium.
What actually changes
- Carbon-footprint declarations and, later, performance classes and maximum-footprint thresholds for EV and industrial batteries.
- Recycled-content targets for cobalt, lead, lithium and nickel.
- Supply-chain due diligence for raw materials.
- Battery passports for EV and industrial batteries, and stricter producer-responsibility for portable ones.
How it hits you
A laptop or e-bike battery should be easier to replace over time. EV buyers get footprint information. You do not register a passport.
For citizens
What this does to everyday life
Rights, bills, and what you can ignore. You are usually not the one who files — companies and states are.
Replaceable packs and a cleaner EV battery
Over the phase-in, portable batteries should be easier to remove, and EV/industrial packs carry footprint and passport information. You do not register anything.
Rights you actually get
- Information on footprint and, in time, easier replacement of portable batteries.
Costs and trade-offs
- Devices and cars may cost more. Collection points should multiply.
What you can do
- Take portable batteries to a collection point rather than the residual bin.
What you can ignore
- You are not the producer. The brand on the pack usually is.
If something goes wrong
Municipal waste service; national environment helpline.
More citizen notes across files: For people
Heard this? Not quite.
Claim: Only carmakers are in.
Portable, industrial, LMT (scooters, bikes) and EV batteries each have a chapter. Light-means-of-transport is a busy SME corner.

Who this is for: EU manufacturers, energy and importers. Regulation (EU) 2023/1542. Duties roll from 2024 through 2028 (passports, due diligence, recycled content).
Scope
- You manufacture, import, or put a battery or a battery-containing product on the EU market.
First 90 days
- Week 1: Classify every SKU: portable, LMT, industrial, EV, SLI.
- Month 1: Producer-responsibility registration in the Member States you sell into.
- This year: Footprint data path and due-diligence system for the 2027 wave.
Penalties: Market withdrawal, national fines, public non-compliance lists.
For companies
How to stay on the right side of this file
Practical order of work, not a substitute for counsel. Producers and importers of portable, industrial, LMT and EV batteries, and vehicle OEMs.

Producers and importers of portable, industrial, LMT and EV batteries, and vehicle OEMs.
Effort
A scoped programme this year beats a scramble at the apply-date.
Budget
SME: owner time plus one honest vendor. Large: a named lead, not a taskforce slide.
Roles in this file
The same company can wear more than one hat. Classify before you buy a tool.

Are you in scope?

Usually not, if
- A software firm with no hardware.
- A garage that only fits batteries supplied by an already-registered producer — still check producer-responsibility.

If you skip this
- Treating the pack assembler as the only producer when the brand puts its name on the device.

Ask vendors
- What is the carbon-footprint dataset for this cell?
- Can you support due diligence on cobalt, lithium, nickel, natural graphite?
Where programmes usually break
- Treating the pack assembler as the only producer when the brand puts its name on the device.
Call counsel when
- Market withdrawal, national fines, public non-compliance lists.
- A supervisor letter, a dawn information request, or a deal that warrants this file.

Legal architecture and duties
For counsel, compliance, and policy teams. Not advice. The Official Journal still wins.
- Instrument
- Regulation
- Legal basis
- Art 114 TFEU · Regulation (EU) 2023/1542
- Application
- Staggered from 2024; due diligence and several footprint duties around 2027; recycled-content and passport milestones into 2028.
A product, waste and due-diligence statute for batteries. Producer-responsibility is live; the heavy industrial/EV chapters are a programme. Do not wait for the last milestone to start footprint and cobalt/lithium mapping.
How the file is built
Categories
Portable, SLI, LMT, EV, industrial — different duties.
Chapters on footprint, recycled content, due diligence, passport, waste
Each has its own apply-date. Read the category, not the press headline.
Operators
| Role | Who | Core duties |
|---|---|---|
| Producer | Manufacturer, importer, or brand that puts a battery or battery-containing product on the market. | Registration, collection, footprint, due diligence, passport as applicable. |
Scope
Placing on the Union market. Export from the Union is also touched by waste rules.
In
- Batteries and modules in the listed categories
- Products that contain them
Out, or narrower than assumed
- Some military and space uses
- Equipment specifically designed for those uses as carved out
Operative provisions
| Anchor | Rule | What it does in practice |
|---|---|---|
| Art 7 | Carbon footprint. | Methodology acts; then classes and max values. |
| Art 8 | Recycled content. | Contract the recyclate years ahead. |
| Arts 47–50 | Due diligence. | Policy, risk, third-party verification for in-scope operators. |
| Art 77 | Battery passport. | Unique identifier and data carrier for EV/industrial. |
Secondary law and guidance
- Commission methodology for carbon footprint
- Due-diligence guidance
National layer. Producer-responsibility schemes and collection are national. Registration in each Member State you sell into is still a thing.
How it sits with other files
Enforcement and private rights
Who
Market surveillance and environment authorities.
Tools
Fines, withdrawal, naming.
Private rights
Limited; product-liability overlay if a pack injures.
Risk register
| Risk | Signal | Control |
|---|---|---|
| Unregistered producer | Selling e-bikes without a national PR scheme | Register before the sales season. |
| 2027 due-diligence gap | No cobalt/lithium map | Start from conflict-minerals files and expand. |
Open issues
- Footprint methodology fights.
- Recycled-content availability.
- LMT enforcement on e-bikes.
